1. Parents and Guardians
Please read these Terms and Conditions carefully before submitting your details to use The Workers website. If you consent to your child using this website, you agree to ensure that your child will also abide to these terms and conditions.
2. Introduction
By using the website located at www.theworkers.com.au ("the Site") you agree to be bound by these terms and conditions ("the Agreement").
This Agreement is binding between Southern Cross Austereo Pty Ltd (“SCA”) and You ("the User"). SCA may modify and vary these terms and conditions without notice and will publish the modified Terms and Conditions on the site.
We recommend that you revisit this Agreement from time to time and note any changes to this Agreement.
3. General
This Site may be accessed by the User only for non-commercial use, private use and individual use. Unauthorised use, unauthorised linking any third party websites is prohibited.
4 Entire Agreement.
This Agreement constitutes the entire agreement between the User and SCA in relation to use of the site. Should any part of this Agreement be deemed invalid, illegal, unlawful or otherwise unenforceable, that part of the Agreement shall be deemed to be severed from this Agreement. All other parts of this agreement shall remain in force and binding upon the parties to this Agreement.
5. Registration
In order to use the Site, the User must register their details on the Registration Page by inserting their name, state and email into the registration field on the website.
The User will then be sent a confirmation email from The Workers to the Users nominated email address.
The user will be sent email updates which will contain promotional information regarding The Workers which include but will not be limited to tour dates, merchandise releases, information on any sales and general updates.
The User agrees to notify SCA if they suspect any unauthorised use of their login Name and account information. The User is solely responsible for all use of their login name and password.
6. Rights (Including copyright)
All rights, title and interest (including copyright) in the material included on the Site remains the property of SCA. The User may not copy, rearrange, vary, adapt, communicate, distribute or publish the material contained on this website.
Should the User download any contents from the Website, such Content is licensed to the User and may only be used by the User in a private, individual and non-commercial manner.
By registering their details on the Website, each Users assigns to SCA all rights including present and future copyright in any materials that they may submit on the Website.
The User agrees not to assert any moral rights in respect of any material (wherever and whenever such rights are recognised) against SCA, its assigns, licensees and successors in title; and the User undertakes that their submission is not in breach of any third party intellectual property rights.
7. Privacy and use of personal information
Any personal information supplied by a User of this Website will be used by SCA in accordance with its Privacy Policy. Please refer to the Privacy Policy by visiting the Website for more information as entry into this Agreement means that a User shall not be bound by that policy. All Users of this website may have their details removed from the SCA’s database by simply contacting SCA or by sending an email to privacy@sca.com.au.
8. Release and Indemnity
The User agrees to defend, indemnify and hold harmless SCA, our officers, directors, employees, agents, subcontractors, licensors, and suppliers, from and against all claims, actions, demands, liabilities and settlements, including, without limitation, reasonable legal and accounting fees, arising in connection with your use of the Website (including, without limitation, your Posting of any User Content), a breach of any of your representations and warranties or your breach of any of these terms and conditions.
9. Disclaimer
To the extent permitted by law, SCA (and our suppliers and licensors) expressly disclaim any and all representations, warranties and conditions of any kind or nature, whether express or implied, including, without limitation, representations, warranties and conditions regarding performance, merchantability, fitness for a particular purpose, title, accuracy and non-infringement. To the extent permitted by law, SCA make no representation or warranty: (a) regarding any specific results, developments or outcomes from the use of the Site; (b) that the Site may always be accessed on an interrupted basis; (c) that any information on the Site will be accurate or reliable; (d) that the Site and material on the Site is free of viruses, security risks or other harmful components. SCA does not assume any obligation to monitor the activities of Users, subscribers or any third parties accessing or conducting any activity involving the Site.
10. Limitation on liability
To the maximum extent permitted by law:
SCA have no liability to the User, whether under contract for breach of these terms, in negligence, in any other tort, in equity or for any other common law or statutory cause of action arising in relation to these terms, the Website, Content or the Service or any linked websites or online material or data.
For the avoidance of doubt, it is the Users responsibility to monitor your and/or your child’s use of the Site and to ensure that this use is not excessive. We disclaim any liability for any physical or mental injury arising out of excessive use of the site and/or the internet.
Nothing in the Agreement is intended to exclude, modify or restrict any right that you may have under applicable legislation.
11. Governing law
This Agreement shall be governed by the laws of New South Wales, Australia and you irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
